Which tips qualify
Tips must be voluntary — cash or card tips, or tips shared through a pool — and paid by a customer who decides the amount. Mandatory service charges or automatic gratuities added to the bill generally do not qualify. You must work in an occupation that customarily and regularly received tips before 2025; the Treasury Department publishes the list of eligible occupations. It covers categories such as food and beverage service, hospitality, entertainment, personal services, delivery and transportation. Check the current list on IRS.gov for your job title.
Self-employed workers
Independent contractors in a listed occupation can qualify, but the deduction cannot exceed the net income from that business, and specified service trades or businesses (for example health, law, consulting and financial services) are excluded.
Worked example
Dev is a single bartender who reported $30,000 in tips and has a $60,000 MAGI. The cap is $25,000, and no phase-out applies, so he deducts $25,000. Using the 2026 standard deduction ($16,100) his taxable income falls from $43,900 to $18,900. All of the deduction comes out of the 12% bracket, saving roughly $3,000.
Phase-out and eligibility limits
- Above $150,000 MAGI ($300,000 joint) the deduction falls by $100 per $1,000 of excess.
- Married couples must file jointly.
- The tips must be reported on your return; unreported tips do not qualify.
- A valid Social Security number is required.
How to claim it
- Keep a daily tip record or use the amounts on your W-2, tip statements or 1099 forms.
- Complete the tips section of Schedule 1-A, including your occupation code.
- Carry the amount to Form 1040. No itemizing needed.
Frequently asked questions

Is the $25,000 limit per person or per return?
Per return. Joint filers share one $25,000 cap.
Are mandatory gratuities included?
Generally not. The tip must be voluntary and the customer must set the amount.
Can gig and delivery workers claim it?
If the occupation is on the Treasury list and the tips are voluntary, yes. The deduction cannot exceed net business income.
